A first Indonesia hire is not simply a question of who runs payroll. Forming a local entity, using a local employer solution, or engaging a genuinely independent contractor each creates a different operating file. The right route depends on the duration of the work, the degree of day-to-day control and the plan for the Indonesian market.

Entity, employer solution or contractor: where should the decision start?

Start with the entity route when the business expects to build a regular team, sign local customer contracts or operate in Indonesia over the long term. A suitable local employer solution can simplify an initial, limited hire. A contractor model may suit a defined outcome that the individual performs independently. The label is not decisive: the actual working arrangement needs to be defensible.

What matters in contractor classification?

Indonesia’s Manpower Law defines an employment relationship as one based on an employment agreement and containing the elements of work, wages and orders. If the company gives continuing directions, sets working hours, pays regular remuneration and manages the individual as part of the business, do not rely on a contract headed “contractor” alone. Review scope, independence, delivery acceptance and payment mechanics before work begins. Official Manpower Law, Article 1(15).

When does a PKWT differ from indefinite employment?

A fixed-term employment agreement (PKWT) can be based on a period or completion of specified work. Government Regulation 35/2021 says a PKWT cannot be made for permanent work and sets out the categories relevant to time-based and task-based arrangements. Test the role’s continuing nature, evidence that the project will end and the contract drafting together. Government Regulation 35/2021, Articles 4–5.

What should be ready before payroll is switched on?

Build the hire file around the job description, remuneration components, working pattern, contract type and onboarding evidence. For wage-receiving workers, BPJS Ketenagakerjaan states that the employer prepares the documents for participant registration. What must be checked in outsourcing or EOR arrangements?

Do not assume that a third party is merely a payroll processor. Regulation 35/2021 defines an outsourcing company as a legal entity carrying out specified work under an agreement with the client company, and requires the outsourcing company to be a legal entity meeting business-licence requirements. Confirm the provider’s local status, scope, employing party, data flows and allocation of responsibilities in writing. Government Regulation 35/2021, Articles 1, 19–20.

What is a practical implementation sequence?

  1. Document the role, its expected duration and the daily-management model.
  2. Compare entity, employer solution and independent-contractor routes for that specific role.
  3. Confirm the contract type and registration responsibilities through a local review.
  4. Assign payroll inputs, approval ownership and record retention before signature.
  5. After the first payroll cycle, test whether the actual working arrangement still matches the file.
