A foreign company hiring in Lithuania must decide who the legal employer is and how local payroll, social-insurance reporting and tax withholding will be operated before the employee starts. A signed offer alone is not a payroll process.

Choose the employment route before recruiting

Compare a Lithuanian entity, a qualifying local registration or branch where appropriate, and an employer-of-record arrangement. The answer depends on where work is performed, who directs the employee, permanence of activity, payroll responsibility and tax exposure. Do not label an employee a contractor merely to avoid setup.

Put the employment contract and data file in place

The Lithuanian Labour Code is the primary legal framework for employment relations. Prepare the agreed role, workplace, working time, pay, start date and required employee data in a controlled file. For a non-Lithuanian personal number, Sodra’s employer guidance says an identity document must be supplied before the 1-SD notification.

Register before work starts

Sodra’s guidance for insurers describes the 1-SD notification in the employment process. Assign a payroll owner who can submit, evidence and reconcile the notification before the employee begins work. Do not make the first salary payment the test of whether registration was completed.

Build a recurring payroll control

Each period should reconcile approved gross pay, variable pay, absences, withholding, social-insurance data, payment instruction and filed reports. The State Tax Inspectorate (VMI) is the official tax authority; use its current guidance for employer withholding and reporting rather than a stale payroll-rate table.

Decide what the parent company and provider each own

Outsourcing payroll or using EOR can shift administration, but it does not remove the need to document who employs, directs and approves the work. Keep written responsibilities for contracts, HR decisions, payroll inputs, filings, payment release and employee communications.
