A foreign-owned US LLC can be useful for a commercial project, but incorporation, an EIN, banking onboarding and information-return compliance are separate workstreams. Treat them as a sequence with named owners, not as a single “LLC package”.

Start with the tax classification and ownership record

Before applying for an EIN, map the legal owner, the LLC’s federal tax classification, the responsible party, address, business activity and expected related-party flows. A foreign-owned single-member LLC that is disregarded for US federal income-tax purposes is not automatically free of reporting; its ownership and reportable transactions must be assessed against the Form 5472 instructions.

Apply for an EIN with an auditable SS-4 file

The IRS says Form SS-4 is the application for an Employer Identification Number. Keep the completed form, submission method, IRS confirmation and the facts used to complete the responsible-party and business-activity fields together. The SS-4 instructions specifically address a foreign-owned US disregarded entity required to file Form 5472.

Plan Form 5472 before money moves

The Form 5472 instructions explain the information-return framework for reportable transactions involving a foreign-owned US disregarded entity and related parties. Build a ledger that separates owner contributions, reimbursements, loans, service charges and distributions. Do not wait until the annual filing window to reconstruct payment purpose, counterparty and currency evidence.

Treat bank onboarding as evidence preparation, not an entitlement

A bank or payment provider makes its own onboarding decision. Prepare a consistent evidence pack: formation record, EIN confirmation, ownership chart, IDs and address evidence required by the provider, business explanation, expected counterparties and source-of-funds narrative. A US EIN supports identification; it does not compel account approval.

Choose the operating model before hiring or contracting

A US LLC can have tax, sales-tax, employment, licensing and treaty consequences beyond its federal EIN file. Confirm whether the company will trade, employ, hold inventory, receive US-source income or merely contract with suppliers. That decision changes the compliance calendar and which advisers must sign off.
